Brassbear Solutions helps clients to prepare for the imminent changes in OHS legislation. Harmonisation of the OHS legislative framework will bring about changes across all Australian jurisdictions. Some of the key changes that will come into effect in January 2012 include a primary duty of care being placed on a person conducting a business undertaking, a requirement of persons conducting a business undertaking to consult with all stakeholders, a significant increase in OSH penalties (e.g. $1.5m penalty for a ‘Body Corporate’ and $300,000 for an Officer) and a positive obligation on Directors to demonstrate due dilligence.
Importantly, the provision for Officers to demonstrate due dilligence requires those persons to actively demonstrate their organisation is managing and meeting its OHS obligations. Failure to demonstrate this may result in regulators prosecuting the Officer and the organisation irrespective of whether there is an obvious breach in legislation.
